HomeMy WebLinkAbout2016-1018 Administration of ConflictDisclosure StatementsRESOLUTION NO. 2016-1018 RESOLUTION OF TROPHY CLUB MUNICIPAL UTILITY DISTRICT NO. 1 RELATING TO ADMINISTRATION OF CONFLICTS DISCLOSURE STATEMENTS WHEREAS, Trophy Club Municipal Utility District No. 1 (the "District") is a conservation and reclamation district created under and essential to accomplish the purposes of Section 59, Article XVI of the Texas Constitution, and the District currently operates pursuant to Chapters 49 and 54, Texas Water Code, as amended; WHEREAS, during the 2015 regular legislative session, the Texas Legislature passed H.B. 1295, enacting conflicts disclosure legislation now codified at Section 2252.908 of the Texas Government Code; WHEREAS, the statute generally prohibits governmental entities from entering into certain contracts with a business entity unless the business entity, in accordance with the statute and rules adopted by the Texas Ethics Commission, submits a disclosure of interested parties on a form prescribed by the Texas Ethics Commission; WHEREAS, under the statute and related rules adopted by the Texas Ethics Commission, governmental entities are generally required to create unique contract identification numbers for business entities to electronically submit a "Certificate of Interested Parties Form" on the Texas Ethics Commission's website. Upon receipt of a completed certification of filing from a business entity, the governmental entity is required to notify the Texas Ethics Commission of the receipt of the certified filing on the agency's electronic platform not later than the 301h day after the date of receipt of the disclosure form; WHEREAS, the District is a governmental entity subject to the requirements of Section 2252.908 of the Texas Government Code; and WHEREAS, in order to ensure timely compliance with the requirements of Section 2252.908 of the Texas Government Code, the Board of Directors desires to adopt this Resolution authorizing its staff to create contract identification numbers, to receive disclosure statements, and to timely notify the Texas Ethics Commission of the receipt of disclosure statements in accordance with the statute and ruled adopted by the Texas Ethics Commission. Now, Therefore, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF TROPHY CLUB MUNICIPAL UTILITY DISTRICT NO. 1 THAT: Section 1. The matters and facts recited in the preamble to this Resolution are found to be true and correct and the same are incorporated herein as a part of this Resolution. 1 of2 Resolution No. 2016-1018 Section 2. The Board of Directors hereby authorizes and directs the District Secretary to assign contract identification numbers, to receive disclosure statements from business entities seeking to contract with the District, to timely notify the Texas Ethics Commission of receipt of certified disclosure statements, and to otherwise comply with all requirements of the District required for compliance with Section 2258.908 of the Texas Government Code and the related rules adopted by the Texas Ethics Commission. Section 3. Upon approval, an executed copy of this Resolution shall be retained in the permanent records of the District. PASSED AND APPROVED this 18th day of October, 2016.
